The Special Court for Sierra Leone and the Extraordinary Chambers for Cambodia represent a departure from the model established by the International Criminal Tribunal for the former Yygoslavia and the International Criminal Tribunal for Rwanda. The SCSL and the ECC have often been referred to as “mixed” or “hybrid” tribunals in which there are significant domestic and international components. The tribunals include a combination of domestic and international judges, utilize domestic and international laws and are administered by a prosecutorial team (...) composed of domestic and international lawyers. Many of these institutional changes have been brought about because of criticisms of the ICTY and the ICTR. The fundamental question of this article is whether these mixed tribunals are a more effective mechanism for providing justice and reconciliation than purely international solutions. This is an important question because both the international community and states are moving in the direction of mixed tribunals. (shrink)

This special issue of Human Rights Review is devoted to an exploration of the current human rights research agendas within the political science discipline. Research on human rights is truly an interdisciplinary quest in which various epistemologies can contribute to each other and form a larger dialogue concerning rights and wrongs. This special issue is devoted to an expansive understanding of the state of research on human rights in the political science discipline. One common theme throughout these contributions is the (...) need for a more nuanced conceptualization of human rights, tools to promote these rights and as social scientists, methodologies employed to study these rights. A second theme is the policy relevance that can be derived from our empirical analysis. This volume demonstrates that the integration of theoretically and normatively rich concepts, empirical social science, and policy relevance do not have to be mutually exclusive when studying human rights. This article examines how international institutions serve to diffuse human rights norms and create judicial capacity building in post-conflict societies. Specifically, we examine how the International Criminal Tribunal for the former Yugoslavia (ICTY) and the Office of the High Representative have influenced the reform of domestic courts in Bosnia and Herzegovina (BiH). We place these reforms within the broader debate over restructuring the complex system of government in BiH. Since 2005, domestic courts in BiH have had jurisdiction over the following: (...) (1) Cases which were initially under the jurisdiction of the domestic courts but remanded to the ICTY and recently returned to BiH. (2) Cases which originated at the ICTY and have been transferred to the State Court, and (3) new cases which originated and remained in the domestic court system. We find that while human rights norms have been incorporated into the new legal code, the diffusion of these human rights norms has been inadequate because of the lack of judicial capacity building. While some courts in the capital enjoy significant resources, the vast majority of cases will be tried at provincial courts which are under-funded and unable to prosecute the significant number of cases. Moreover, the government structure of BiH has had a decidedly negative impact on the prosecution of these cases. Ultimately, the rule of law requires consistency of approach and funding to protect human rights throughout the state. (shrink)

Although the use of truth and reconciliation commissions (TRCs) has grown considerably over the last 3 decades, there is still much that we do not know concerning the choice and the structuring of TRCs. While the literature has focused primarily on the effects of TRCs, we examine the domestic and the international factors influencing the choice of a commission in sub-Saharan Africa from 1974 to 2003 using pooled cross-sectional time series. We find that states which adopted a TRC prior to (...) South Africa were generally repressive centralized regimes which used the truth commission as political cover. However, since South Africa’s TRC, democratizing states have been more likely to adopt a truth commission as a form of transitional justice. (shrink)

Brexit activists demonstrating outside the British Houses of Parliament were studied in situ to examine their potential for pro-group extreme behavior. This involved activists of two polarized, opposing views; those of Leave and Remain. The research engaged concepts linking the different theoretical perspectives of identity fusion and personal construct psychology. The study measured participants' degree of fusion to their group using a verbal measure. Willingness to undertake extreme acts was assessed in several ways: a measure of willingness to fight for (...) the group, adaptations of the trolley dilemma and questions regarding political violence. Individual construing was examined using repertory grid technique and a semi-structured interview. Results were similar for both Leave and Remain participants. The majority of activists identified as “fused” to their group and, if so, were more likely to undertake hypothetical extreme behavior compared to those who did not identify as “fused.” Repertory grid technique indicated that becoming an activist provided individuals with a clearer and more positive view of themselves. Opposition activists were construed more negatively and extremely than fellow activists, and this construal was associated with an increased willingness to undertake extreme pro-group behavior. This was consistent with the personal construct model of radicalization and was heightened in those who were “fused.” Interview data provided support for the constructivist model and revealed characteristics and concerns of the two groups. Overall, the findings indicate that campaigning organizations contain fused individuals, who are more likely to undertake hypothetical pro-group violence including self-sacrifice. This has broader implications which may be particularly pertinent, given the violent impact of extremist activists around the globe. (shrink)

This study investigated whether temporal clustering of autobiographical memories around periods of self-development would also occur when imagining future events associated with the self. Participants completed an AM task and future thinking task. In both tasks, memories and future events were cued using participant-generated identity statements . Participants then dated their memories and future events, and finally gave an age at which each identity statement was judged to emerge. Dates of memories and future events were recoded as temporal distance from (...) the identity statement used to cue them. AMs and future events both clustered robustly around periods of self-development, indicating the powerful organisational effect of the self. We suggest that life narrative structures are used to organise future events as well as memories. (shrink)

How do people understand questions about cause and prevent? Some theories propose that people affirm that A causes B if A's occurrence makes a difference to B's occurrence in one way or another. Other theories propose that A causes B if some quantity or symbol gets passed in some way from A to B. The aim of our studies is to compare these theories' ability to explain judgements of causation and prevention. We describe six experiments that compare judgements for causal (...) paths that involve a mechanism, i.e. a continuous process of transmission or exchange from cause to effect, against paths that involve no mechanism yet a change in the cause nevertheless brings about a change in the effect. Our results show that people prefer to attribute cause when a mechanism links cause to effect. In contrast, prevention is sensitive both to the presence of an interruption to a causal mechanism and to a change in the outcome in the absence of a mechanism. In this sense, ‘prevent’ means something different than ‘cause not'. We discuss the implications of our results for existing theories of causation. (shrink)

Nursing professionals in a variety of practice settings routinely use implied consent. This form of consent is used in place of or in conjunction with informed or explicit consent. This article looks at one aspect of a qualitative exploratory study conducted in a Day of Surgery Admission unit. This article focuses on the examination of nurses’ understandings of implied consent and its use in patient care in nursing practice. Data were collected through one-on-one interviews and analysed using a thematic analysis. (...) Nurses participating in this study revealed that they routinely used implied consent in their nursing practice. This article will look at whether implied consent supports or impedes a patient’s autonomy. (shrink)

An explicit categorical equivalence is defined between a proper subvariety of the class of \-algebras, as defined by Di Nola and Dvurečenskij, to be called \-algebras, and the category of semi-low \-rings. This categorical representation is done using the prime spectrum of the \-algebras, through the equivalence between \-algebras and \-groups established by Mundici, from the perspective of the Dubuc–Poveda approach, that extends the construction defined by Chang on chains. This paper explores the relationships between Christianity, Englishness, and ideas about the southern English landscape in the writings of the 1930s and 1940s rural commentator, H.J. Massingham. The paper begins by looking in general terms at the conjunction of religious and national identities in the context of national landscapes before moving on to consider in more detail one particular instance of this in the writing of H.J. Massingham. Massingham's understanding of a divine natural order, his construction of a kind of (...) 'divine Englishness' and the way in which he relates this to particular English landscapes is explored. In particular, the paper investigates the natural, social and political power relationships which are embedded in Massingham's work, and suggests that his writing provides an interesting example of one way in which theological reasoning can reflect and reinforce concepts of a naturally ordered national identity. A novel theoretical framework for an embodied, non-representational approach to language that extends and deepens enactive theory, bridging the gap between sensorimotor skills and language. -/- Linguistic Bodies offers a fully embodied and fully social treatment of human language without positing mental representations. The authors present the first coherent, overarching theory that connects dynamical explanations of action and perception with language. Arguing from the assumption of a deep continuity between life and mind, they show that this continuity extends to language. (...) Expanding and deepening enactive theory, they offer a constitutive account of language and the co-emergent phenomena of personhood, reflexivity, social normativity, and ideality. Language, they argue, is not something we add to a range of existing cognitive capacities but a new way of being embodied. Each of us is a linguistic body in a community of other linguistic bodies. The book describes three distinct yet entangled kinds of human embodiment, organic, sensorimotor, and intersubjective; it traces the emergence of linguistic sensitivities and introduces the novel concept of linguistic bodies; and it explores the implications of living as linguistic bodies in perpetual becoming, applying the concept of linguistic bodies to questions of language acquisition, parenting, autism, grammar, symbol, narrative, and gesture, and to such ethical concerns as microaggression, institutional speech, and pedagogy. Often overlooked by historians, specialist gardeners with an expert understanding of both native and exotic plant material were central to the teaching and research activities of university botanic gardens. In this article various interrelationships in the late Georgian period will be examined: between the gardener, the garden, the botanic collection, the medical school and ways of knowing. Foregrounding gardeners’ narratives will shed light on the ways in which botanic material was gathered and utilized for teaching and research purposes, particularly for (...) medical students, as well as highlighting the importance of the garden as a repository of botanic material for the classroom. In this way, the blurred lines between art and science, skill and scholarly activity, and shared pedagogic practices between botany and anatomy will be revealed. (shrink)

This article explores the contributions of women scholars, writers and artists to our understanding of the medieval past. Beginning with a contemporary artists book by Liz Mathews that draws on one of Boethius‘s Latin lyrics from the Consolation of Philosophy as translated by Helen Waddell, it traces a network of medieval women scholars of the nineteenth and twentieth centuries associated with Manchester and the John Rylands Library, such as Alice Margaret Cooke and Mary Bateson. It concludes by examining the translation (...) of the Old English poem, The Wife‘s Lament, by contemporary poet, Eavan Boland. The art of Liz Mathews and poetry of Eavan Boland and the scholarship of women like Alice Cooke, Mary Bateson, Helen Waddell and Eileen Power show that women‘s writing of the past – creative, public, scholarly – forms a strand of an archive of women‘s history that is still being put together. This article reflects on the problem of false belief produced by the integrated psychological and algorithmic landscape humans now inhabit. Following the work of scholars such as Lee McIntyre (Post-Truth, MIT Press, 2018) or Cailin O’Connor and James Weatherall (The Misinformation Age: How False Beliefs Spread, Yale University Press, 2019) it combines recent discussions of fake news, post-truth, and science denialism across the disciplines of political science, computer science, sociology, psychology, and the history and philosophy of science that variously address (...) the ineffectiveness, in a digital era, of countering individual falsehoods with facts. Truth and falsehood, it argues, rather than being seen as properties or conditions attached to individual instances of content, should now be seen as collective, performative, and above all persuasive phenomena. They should be practically evaluated as networked systems and mechanisms of sharing in which individually targeted actions are combining with structural tendencies (both human and mechanical) in unprecedented ways. For example, the persuasive agency of apparent consensus (clicks, likes, bots, trolls) is newly important in a fractured environment that only appears to be, but is no longer ‘public’; the control of narratives, labels, and associations is a live, time-sensitive issue, a continuous contest, or ongoing cusp. Taking a social approach to truth yields observations of new relevance; from how current strategies of negative cohesion, blame, and enemy-creation depend crucially on binary ways of constructing the world, to how the offer of identity/community powerfully cooperates with the structural tendencies of algorithm-driven advertiser platforms towards polarisation. Remedies for these machine-learned and psychological tendencies lie in end-user education. So the Arts and Humanities, whether via comparisons with previous historical periods, or via principles of critical thinking and active reading, offer crucial resources to help counter what since 1997 silicon valley executives and scholars have called ‘persuasive technology’ (Fogg in Persuasive Technology: Using Computers to Change What we Think and Do, Morgan Kaufmann, 2003; Hamari et al. (eds) in Persuasive Technology, Springer International Publishing, 2014; Harris in How a Handful of Tech Companies Control Billions of Minds Every Day, 2017; Lanier in Who Owns the Future? Simon & Schuster, 2014 and Ten Arguments for Deleting your Social Media Accounts Right Now, Picador, 2019). The article proposes a paradigm shift in public understandings of this new social environment: from a culture of discovery, where what matters is what exists or is in fact the case, to a culture of iteration, where what matters is what gets repeated. It’s widely agreed that animal pain matters morally – that we shouldn’t, for instance, starve our animal companions, and that we should provide medical care to sick or injured agricultural animals, and not only because it benefits us to do so. But do we have the same moral responsibilities towards wild animals? Should we feed them if they are starving, and intervene to prevent them from undergoing other forms of suffering, for instance from predation? Using an example that includes both (...) wild and domesticated animals, I outline two contrasting ways of thinking about our moral responsibilities with respect to assisting animals that are apparently in need. One approach is based entirely around animals’ capacities; the other takes context and historical relations into account as well. While not attempting to adjudicate between these views, I’ll point out the advantages and difficulties of both. (shrink)

Prompted by our commentators, we take this response as an opportunity to clarify the premises, attitudes, and methods of our enactive approach to human languaging. We high-light the need to recognize that any investigation, particularly one into language, is always a concretely situated and self-grounding activity; our attitude as researchers is one of knowing as engagement with our subject matter. Our task, formulating the missing categories that can bridge embodied cognitive science with language research, requires avoiding premature abstractions and clarifying (...) the multiple circularities at play. Our chosen method is dialectical, which has prompted several interesting observations that we respond to, particularly with respect to what this method means for enactive epistemology and ontology. We also clarify the important question of how best to conceive of the variety of social skills we progressively identify with our method and are at play in human languaging. Are these skills socially constituted or just socially learned? The difference, again, leads to a clarification that acts, skills, actors, and interactions are to be conceived as co-emerging categories. We illustrate some of these points with a discussion of an example of aspects of the model at play in a study of gift giving in China.Keywords: Enactive epistemology, Enactive ontology, Dialectics, languaging, Shared know-how. PRO-Mueve Relaciones Sanas(PRO-Mote Healthy Relationships) is a gender-based violence and dating violence prevention program targeted at adolescents. The program has been designed to be implemented during three consecutive courses [from the first to third year of Spanish mandatory secondary education (ESO)] in 8 annual sessions, imparted by university students who have been previously trained and supervised by university professors. The present study evaluates the effects of the program after the first year of implementation through a quasi-experimental design (Intervention GroupN= 181; (...) Quasi-control groupN= 62;Mage= 12.11; SDage= 0.57; 54.7% girls) and assesses whether there are gender differences in the outcomes. The results obtained evidenced a significant reduction in benevolent sexism in the intervention group compared to the quasi-control group. Regarding hostile sexism, it was found to increase significantly in the quasi-control group, while it remained stable in the intervention group. Thus, there were significant differences between both groups after the intervention. Likewise, romantic love myths were found to decrease significantly, and knowledge about gender-based violence increased significantly in the intervention group between the two time points assessed, although there were no significant differences with the quasi-control group. No gender differences in the outcomes of the program were observed. The obtained results supported the efficacy of the program during the first year of intervention in the first course of the ESO and laid the foundation for the following phases of intervention. Analysing the websites of 127 corporations from emerging countries, such as Brazil, Chile, China, India, Indonesia, Mexico, Thailand and South Africa, it becomes evident that both country of origin and industry sector have a significant influence over CSR information disclosure on the web (CSRIDOW). CLARE PALMER | : This paper argues that there is no simple rift between animal liberation and environmental ethics in terms of strategies for environmental conservation. The situation is much more complicated, with multiple fault lines that can divide both environmental ethicists from one another and animal ethicists from one another—but that can also create unexpected convergences between these two groups. First, the paper gives an account of the alleged rift between animal liberation and environmental ethics. Then it’s argued (...) that this rift was always exaggerated. For instance, animal ethicists who prioritize aggregate animal welfare have always converged with environmental ethicists in supporting certain cases of hunting and culling, and, in doing so, they have diverged from animal rights theorists, who generally oppose these practices. Pervasive threats such as climate change make it likely that environmental ethicists will also diverge from one another in terms of the conservation strategies they support, depending on what values they prioritize. For instance, conservation strategies that protect species may not necessarily protect other environmental values such as ecosystem flourishing or wildness. The paper concludes that conservation under climate change is likely to bring both new divergences and new convergences, and that these are unlikely to take the form of a rift between animal liberation and environmental ethics. | : Cet article soutient qu’il n’existe pas un clivage simple entre le mouvement de la libération animale et l’éthique environnementale quant aux stratégies de conservation environnementale. La situation est bien plus complexe, de nombreuses lignes de faille pouvant d’une part diviser autant les spécialistes d’éthique environnementale que les spécialistes d’éthique animale et, d’autre part, créer des convergences inattendues entre ces deux groupes. L’article fait d’abord état du prétendu clivage entre le mouvement de la libération animale et l’éthique environnementale, pour ensuite démontrer l’exagération de ce clivage. Par exemple, les spécialistes d’éthique animale qui priorisent le bien-être global des animaux se sont toujours accordé avec les spécialistes d’éthique environnementale pour approuver certains cas de chasse et d’abattage, divergeant par là-même des théoriciens des droits des animaux, qui s’opposent généralement à ces pratiques. De plus, des menaces omniprésentes telles que le changement climatique auront vraisemblablement pour effet de diviser les éthiciens environnementaux selon les stratégies de conservation qu’ils préconisent en fonction de leurs valeurs prioritaires. Ainsi, les stratégies de conservation qui protègent certaines espèces ne protègeront pas nécessairement d’autres valeurs environnementales telles que l’épanouissement des écosystèmes ou la préservation de leur état sauvage. L’article tire la conclusion que, dans le contexte des changements climatiques, la question de la conservation est susceptible de soulever à la fois de nouvelles divergences et de nouvelles convergences, lesquelles ne prendront probablement pas toutefois la forme d’un clivage entre le mouvement de la libération animale et l’éthique environnementale. Filósofos e historiadores da ciência oferecem explicações para cientistas aceitarem ou rejeitaremuma dada hipótese ou teoria, mas, de um modo geral, não apresentam critérios que permitamdeterminar de maneira clara o que seja aceitação e o que seja rejeição. Com o intuitode contribuir para elucidar este problema, foi proposto um método de análise em Martinse Martins, exemplificado pelo posicionamento do naturalista inglês William Bateson diante da teoria cromossômica, no período compreendido entre 1902 e 1926.O objetivo deste artigo é aplicar o método (...) de análise acima mencionado para esclarecer aposição adotada pelo zoólogo Thomas Hunt Morgan diante da hipótese/teoriacromossômica, no período compreendido entre 1903 e 1910-1911. Nossa análise mostraque Morgan rejeitou a teoria cromossômica no período considerado e que sua mudançarepentina de opinião se deveu a uma estratégia profissional. (shrink)

In _Considering Emma Goldman_ Clare Hemmings examines the significance of the anarchist activist and thinker for contemporary feminist politics. Rather than attempting to resolve the tensions and problems that Goldman's thinking about race, gender, and sexuality pose for feminist thought, Hemmings embraces them, finding them to be helpful in formulating a new queer feminist praxis. Mining three overlapping archives—Goldman's own writings, her historical and theoretical legacy, and an imaginative archive that responds creatively to gaps in those archives —Hemmings shows (...) how serious engagement with Goldman's political ambivalences opens up larger questions surrounding feminist historiography, affect, fantasy, and knowledge production. Moreover, she explores her personal affinity for Goldman to illuminate the role that affective investment plays in shaping feminist storytelling. By considering Goldman in all her contradictions and complexity, Hemmings presents a queer feminist response to the ambivalences that also saturate contemporary queer feminist race theories.
